Terms of Purchase

These Terms of Purchase apply to all products and services provided within the State of Florida.

 

Orders & Acceptance

All orders are subject to written acceptance. Quotes are valid for a limited time and may change if project scope, site conditions, materials, or regulations change.

Pricing & Payment

All prices are in U.S. dollars. Payment terms, including deposits and progress payments, are outlined at the time of purchase. Work will not begin until required payments are received. Applicable Florida sales tax will be added where required.

Financing

Any financing or promotional payment options are offered through third-party providers and are subject to approval, eligibility, and provider terms. Financing approval is not guaranteed.

Installation

Installation is performed by trained, insured in-house teams or authorized installers operating within Florida. Installation timelines are estimates and may be affected by weather, permitting delays, site conditions, or other factors outside reasonable control.

The customer is responsible for providing clear access to the site and ensuring suitable installation conditions.

HOA & Community Approvals

It is the customer’s responsibility to obtain all required homeowner association (HOA), condominium association, or community approvals prior to installation. Delays, redesigns, or cancellations caused by HOA requirements or restrictions are not the responsibility of the installer.

Engineering, Permits & Building Codes

Where applicable, engineering calculations are prepared in alignment with Florida Building Code requirements. Permit requirements vary by municipality and are the responsibility of the customer unless otherwise agreed in writing.

Engineering calculations address design wind loads and structural performance but do not guarantee performance against every extreme weather event.

Coastal & Severe Weather Considerations

Coastal, high-wind, and hurricane-prone environments may require additional engineering, anchoring, or permitting. Exposure to salt air, wind-driven debris, flooding, or extreme storm events may affect performance and finish over time.

Damage resulting from conditions exceeding design specifications, storm surge, flooding, flying debris, or other extreme acts of nature is not covered under standard warranty.

Delivery

Delivery dates are estimates only. Risk of loss transfers upon delivery. Delays caused by logistics, weather, or supply conditions do not constitute breach of contract.

Changes & Cancellations

Custom-manufactured products cannot be cancelled or modified once production has begun. Approved changes may result in additional costs and revised timelines.

Warranty

Products are covered by the applicable manufacturer warranty provided at the time of purchase. Warranty coverage excludes damage caused by misuse, improper maintenance, unauthorized modification, corrosion from extreme environmental exposure, or acts of nature beyond design limits.

Limitation of Liability

To the fullest extent permitted by Florida law, liability is limited to the value of the products and services provided. Indirect, incidental, or consequential damages are excluded.

Governing Law

These Terms are governed by the laws of the State of Florida. Venue for any dispute shall lie exclusively in the appropriate Florida court.

Acceptance

Placing an order constitutes acceptance of these Terms of Purchase.
